End-User License Agreement ("Agreement")

Introduction

This End-User License Agreement ("Agreement") governs your use of software applications provided by Result Hosting, a collaboration of developers led by S.K. Pandey, based in Varanasi, India. Our applications, primarily designed for the education sector, are licensed to both domestic and international users. By downloading, installing, or using our Application, you agree to be bound by this Agreement. Please read it carefully before proceeding. If you do not agree, do not use the Application.

Interpretation and Definitions

Terms with capitalized initial letters have specific meanings as defined below, applicable in both singular and plural forms.

Definitions

  • Agreement refers to this End-User License Agreement governing your use of the Application.
  • Application refers to the software provided by the Collaboration, named Result Hosting, downloaded to your Device.
  • Collaboration refers to the Developer's Collaboration Headed By S.K. Pandey, located at B.21/11 Kamachha, Varanasi, Uttar Pradesh 221010, India.
  • Content refers to text, images, or other information you post, upload, or link to via the Application.
  • Device refers to any device accessing the Application, such as a computer, cellphone, or tablet.
  • Third-Party Services refers to services or content provided by third parties that may be included in or linked to the Application.
  • You refers to the individual or entity using the Application, whether in India or internationally.

Acknowledgment

By downloading, installing, or using the Application, you agree to be bound by this Agreement, which forms a legally binding contract between you and the Collaboration. The Application is licensed, not sold, and is intended for use strictly in accordance with this Agreement, primarily for educational purposes. If you do not agree to these terms, do not proceed with using the Application.

License

Scope of License

The Collaboration grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application for personal or educational purposes, subject to this Agreement.

  • Use for non-commercial activities, such as managing educational data or accessing educational platforms.
  • Compliance with all applicable laws, including India’s Information Technology Act, 2000.

You may not permitted to modify, reverse-engineer, sublicense, or use the Application for unauthorized purposes.

Third-Party Services

Third-Party Services, such as educational content providers or cloud services. The Collaboration is not responsible for the accuracy, legality, or quality of these services. You acknowledge that using Third-Party Services is at your own risk and subject to their terms and conditions.

Term and Termination

Upon termination of You must immediately cease using the Application and delete all copies. Termination does not limit the Collaboration’s legal remedies for any breach of this Agreement.

Indemnification

You agree to indemnify and hold harmless the Collaboration, its affiliates, and representatives from any claims, damages, or expenses (including legal fees) arising from your:

  • Use of the Application.
  • Violation of this Agreement or applicable laws.
  • Infringement of third-party rights.

No Warranties

The Application is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. The Collaboration does not guarantee that the Application will:

  • Meet your specific requirements.
  • Operate without interruptions or errors.
  • Be free from viruses or harmful components.

Some jurisdictions may not allow the exclusion of certain warranties, so these limitations apply to the extent permitted by law, including India’s Information Technology Act, 2000.

Limitation of Liability

To the maximum extent permitted by law, the Collaboration’s liability under this Agreement is limited to the amount you paid for the Application, if any. The Collaboration shall not be liable for any special, incidental, indirect, or consequential damages, including but not limited to loss of data, profits, or privacy, arising from your use of the Application or Third-Party Services.

Some jurisdictions may not allow the exclusion of certain damages, so these limitations apply to the extent enforceable under applicable law.

Severability and Waiver

Severability

If any provision of this Agreement is deemed unenforceable, it will be modified to achieve its intent to the extent possible, and the remaining provisions will remain in effect.

Waiver

Failure to enforce any right or provision of this Agreement does not constitute a waiver of that right or provision in the future.

Changes to This Agreement

The Collaboration reserves the right to modify this Agreement at its discretion. Material changes will be communicated via email or on our Website at least 30 days before taking effect. Continued use of the Application after revisions constitutes acceptance of the updated terms. If you do not agree, you must stop using the Application.

Governing Law

This Agreement is governed by the laws of India, excluding its conflict of law principles, and subject to the jurisdiction of courts in Varanasi, Uttar Pradesh. Your use of the Application may also be subject to other local or international laws, depending on your location.

Entire Agreement

This Agreement constitutes the entire understanding between you and the Collaboration regarding the Application, superseding all prior agreements. Additional terms may apply when using other services provided by the Collaboration, which will be communicated at the time of use.
